cookies, web beacons, tags, application analytics software, and other technologies.
These technologies may be used for tracking, advertising, analytics, and personalization
and optimization of a Site.

a. Cookies. Cookies are small text files that are stored on your computer.

  • Persistent cookies remain on the visitor's or user's computer after
    the browser has been closed.

  • Session cookies exist only during a visitor's or user's online
session and disappear from the visitor's or user's computer when
    they close the browser software.

You can instruct your browser to stop accepting cookies. But if you do not
accept cookies, you may not be able to use all portions or all functionality of
a Site.

Please see https://allaboutcookies.org/ for additional information about
cookies.

b. Web beacons. Web beacons or tags (small images embedded into websites
or emails that send information about your computer when you visit a Site or
open an email we send to you) can be used by either us or a service

and use it for other purposes like evaluating how a Site works for research or

target advertisements to you for products offered by us and products and
services offered by service providers, third parties, and/or other parties in
which you might be interested. Ad network providers, advertisers, sponsors,
and/or traffic measurement services may use cookies, JavaScript, web

other technologies are governed by each service provider's, third parties’,
and/or other party's specific privacy policy, not this Privacy Policy.

Users in the United States may opt out of many ad networks. For example,
you may go to the Digital Advertising Alliance ("DAA") Consumer Choice

DAA companies at http://digitaladvertisingalliance.org/participating. You may
also go to the Network Advertising Initiative ("NAI") Consumer Opt-Out Page

service providers, third parties, and/or other parties that are NAI members
at https://www.networkadvertising.org/participating-networks.
Opting out from one or more companies listed on the DAA Consumer Choice
Page at http://optout.aboutads.info or the NAI Consumer Opt-Out Page
at https://optout.networkadvertising.org will remove you from those
companies'; delivery of interest-based content or ads to you, but it does not
mean you will no longer receive any advertising through a Site or on other
websites. Even if you opt out from one or more companies listed on the DAA
Consumer Choice Page or the NAI Consumer Opt-Out Page, you may
continue to receive advertisements, for example, based on the particular
website that you are viewing (i.e., contextually based ads). Also, if your
browsers are configured to reject cookies when you opt out on the DAA or
NAI websites, your opt-out may not be effective. Additional information is
available on the DAA's website at https://youradchoices.com/ or the NAI';s
website at https://www.networkadvertising.org.

f. Do not track. At this time, we do not respond to "Do Not Track" signals sent
from web browsers or other mechanisms that provide users the ability to
exercise choice regarding the collection of personally identifiable information
about a user's online activities over time and across service provider, third-

understanding of how to interpret "Do Not Track" signals.

You may only make a request to know twice within a twelve (12)-month period.

We need to verify your identity or authority to make the request and confirm that the personal information relates to you.

We will use personal information provided in a verifiable consumer request for purposes of verification and will not further disclose the personal information, retain it longer than necessary for purposes of verification, or use it for unrelated purposes.

Response Timing and Format

We endeavor to respond to requests to know, to delete, and to correct within forty-five (45) calendar days. If we require more time (up to an additional forty-five (45) calendar days), we will provide you with notice and an explanation of the reason that we will take more than forty-five (45) calendar days to respond to the request.

We will deliver our written response via postal mail or via email, at your option.

The response we provide will also explain the reasons we cannot comply with a verifiable consumer request (including regarding a request to delete or a request to correct, whether we have complied with such request), if applicable.

Any disclosures we provide will cover the twelve (12)-month period from the date that we receive the verifiable consumer request, provided that you may request that we disclose the required information beyond the twelve (12)-month period with respect to personal information collected on or after January 1, 2022, and we will provide such information unless doing so proves impossible or would involve a disproportionate effort.

For request to know data portability requests, we will provide your personal information in a format that is easily understandable to the average consumer, and to the extent technically feasible, in a structured, commonly used, machine-readable format, which also may be transmitted to another entity at your request without hindrance, including via email.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.

Your Right to Opt Out of Sale/Sharing

You have the right, at any time, to request that we neither sell to nor share with third parties your personal information ("request to opt out of sale/sharing").

You (or your authorized agent) may submit a request to opt out of sale/sharing to us via email.

We will comply with a request to opt out of sale/sharing as soon as feasibly possible and no later than fifteen (15) business days from the date we receive the request.

Once you have opted out of the sale or sharing of your personal information, except as allowed by CPRA regulations, we will wait at least twelve (12) months before asking you to consent to the sale or sharing of your personal information.

We will use personal information provided in a request to opt out of sale/sharing for purposes of complying with the request.

Your Right to Limit Sensitive Personal Information Use

California law gives you the right to request that we limit the use of your sensitive personal information. We do not use any sensitive personal information to make inferences about you and use sensitive personal information only for reasons permitted by the CPRA and the CPRA regulations.

Nondiscrimination

You have the right not to receive discriminatory treatment by us for the exercise of the privacy rights conferred by the CPRA. Unless permitted by the CPRA, we will not

  • deny you goods or services;

  • charge you different prices or rates for goods or services, including through granting discounts or other benefits or imposing penalties;

  • provide you a different level or quality of goods or services;

  • suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services; or

  • retaliate against an employee, applicant for employment, or independent contractor for exercising their rights under the CPRA.

Privacy Notice for Texas Residents

Effective Date and Last Updated: December 31, 2024

This Privacy Notice for Texas Residents ("Notice") supplements the information contained in the Privacy Policy of Davy Gas Inc. and its subsidiaries and affiliates (collectively, "we," "us," or "our") and does not apply to individuals who are Texas residents acting in a commercial or employment context (each, a "consumer" or "you").

The Texas Data Privacy and Security Act (the "TDPSA") defines "personal data" broadly as any information that is linked or reasonably linkable to an identified or identifiable individual. However, the TDPSA definition of "personal data" does not include deidentified data or publicly available information. This Notice uses the TDPSA definition for personal data. "Personal data" as used in this Notice has the same meaning as "personal information" as used in our Privacy Policy.

Categories of Personal Data We Process and Purpose for Processing

Please see "What Information Do We Collect and How Do We Collect It?," "Cookies and Other Technologies; Do Not Track," "How We Can Use the Information We Collect," and "To Whom Do We Disclose Your Information?" in our Privacy Policy to understand the categories of personal data from or about you that we process.

Please see "What Information Do We Collect and How Do We Collect It?," "Cookies and Other Technologies; Do Not Track," "How We Can Use the Information We Collect," "To Whom Do We Disclose Your Information?," "Storage," and "Retention" in our Privacy Policy to understand the purpose for processing personal data.

Categories of Personal Data We Can Share with Categories of Third Parties

Except as otherwise expressly provided in this Notice, we can share any of the categories of personal data listed in "What Information Do We Collect and How Do We Collect It?," "Cookies and Other Technologies; Do Not Track," "How We Can Use the Information We Collect," and "To Whom Do We Disclose Your Information?" in our Privacy Policy with the categories of third parties as described in "What Information Do We Collect and How Do We Collect It?," "Cookies and Other Technologies; Do Not Track," "How We Can Use the Information We Collect," and "To Whom Do We Disclose Your Information?" in our Privacy Policy.

Consumer Rights

You have the right, at any time, to request the following.

  • Confirmation of whether we are processing your personal data and to access such personal data

  • Correction of inaccuracies in your personal data, taking into account the nature of the personal data and the purposes of the processing of your personal data

  • Deletion of personal data provided by or obtained about you

  • If the data is available in a digital format, to obtain a copy of your personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller as defined under the TDPSA without hindrance

You also have the right, at any time, to request to opt out of the processing of the personal data for any of the following purposes (each, a "right to opt out"):

  • targeted advertising,

  • the sale of personal data, and/or

  • profiling in furtherance of a decision that produces a legal or similarly significant effect concerning you.

At this time, since we do not engage in the processing of personal data for any of the foregoing purposes, we do not offer such right to opt out.

Finally, you have the right to not be discriminated against for exercising any of the consumer rights contained in the TDPSA.

Consumer Requests

To exercise your rights as described above, please submit a consumer request to us via email.

A consumer request must:

  • Provide sufficient information that allows us to authenticate your identity as more particularly described in this Notice.

  • Specify the consumer rights you wish to exercise with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will provide information in response to a consumer request up to twice annually per consumer.

We may not be able to comply with a consumer request if we are unable to authenticate the consumer request using commercially reasonable efforts. In such event, we may request that the consumer provide additional information reasonably necessary to authenticate the consumer and the consumer request.

We endeavor to respond to consumer requests within forty-five (45) days of the date of receipt. If we require more time when reasonably necessary, taking into account the complexity and number of the consumer requests (up to an additional forty-five (45) days), we will inform you of, and the reason for, such extension.

If we decline to take action regarding a consumer request, we will inform you within forty-five (45) days of the date of receipt and the response will also describe the justification for declining to take action and provide instructions on how to appeal the decision.

If the data is available in a digital format, for a consumer request to obtain a copy of your personal data that you previously provided to us, we will select a format to provide your personal data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller as defined in the TDPSA without hindrance, including by email.

We do not charge a fee for information provided in response to a consumer request unless requests from a consumer are manifestly unfounded, excessive, or repetitive.

Appeals

You may appeal our decision declining to take action regarding your consumer request by submitting an appeal to us via email.

Within sixty (60) days of the date of receipt of such appeal, we will inform you in writing of any action taken or not taken in response to such appeal, including a written explanation of the reason(s) for the decision. If you are not satisfied with our response, you may contact the Texas Attorney General by clicking [https://oag.my.salesforce-sites.com/CPDOnlineForm] or by calling its Consumer Protection Hotline at (800) 621–0508.
